Liability Waiver

CYPRESS CREEK SHOOTING LODGE, LLC — LIABILITY WAIVER In consideration of being permitted to participate in firearms-related activities located at or sponsored by Cypress Creek Shooting Lodge, LLC, including, but not limited to, the use of shooting ranges, shooting courses, firearms training, and firearms demonstrations, and in consideration of other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned, on behalf of myself, my heirs, successors and assigns (or, if the participant on whose behalf this waiver is being executed is under the age of 18 years of age, the undersigned, as parent or legal guardian of and on behalf of such minor child and his or her heirs, successors and assigns), hereby WAIVES, RELEASES, DISCHARGES and COVENANTS NOT TO SUE Cypress Creek Shooting Lodge, LLC and its owners, officers, agents, and employees, including but not limited to Kayle D. Browning (collectively, the "Released Parties"), from any and all loss, injury, liability and causes of action whatsoever arising out of or relating to any loss, damage or injury, including death, which may be sustained by me (or the minor child on whose behalf I am signing) while participating in any firearms-related activity sponsored by any of the Released Parties or while upon premises owned, leased or otherwise controlled by any of the Released Parties, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OR FAULT OF ANY OF THE RELEASED PARTIES, ANY OF THEIR AGENTS OR EMPLOYEES, OR ANY OTHER THIRD PARTY. I further acknowledge that there are certain inherent risks and hazards associated with participating in firearms-related activities and that I, with full knowledge and awareness of such inherent risks and hazards, elect to participate (or elect to permit the minor child on whose behalf I am signing to participate) in such firearms-related activities and assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me (or the minor child on whose behalf I am signing), as a result of my (or the minor child on whose behalf I am signing) being a participant or observer in firearms-related activities at Cypress Creek Shooting Lodge, LLC, whether caused by the negligence of any of the Released Parties or otherwise. I further agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorneys' fees that Released Parties may incur due to my participation (or the participation of the minor child on whose behalf I am signing) in any firearms-related activities sponsored or conducted by Cypress Creek Shooting Lodge, LLC, whether caused by negligence of the Released Parties or otherwise, to the fullest extent allowed by law. I also agree to indemnify Cypress Creek Shooting Lodge, LLC for any damages caused by me (or the minor child on whose behalf I am signing) to any Cypress Creek Shooting Lodge, LLC property. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND THAT I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A LEGALLY BINDING RELEASE OF LIABILITY AND THAT I SIGN IT OF MY OWN FREE WILL. I CERTIFY THAT I AM 18 YEARS OF AGE OR OLDER OR THAT I AM THE PARENT OR LEGAL GUARDIAN OF THE MINOR ON WHOSE BEHALF THIS WAIVER IS BEING EXECUTED.
